By accessing our website kontrak.social or using the Kontrak™ Apps, or any ancillary applications made available by Kontrak Social Pty Ltd ACN 677 831 097 however accessed, you are agreeing to be bound by our terms and conditions of service, if you don’t agree, that’s fine, we respect your opinion and views and hope you have fun doing something else., We are not going to force you to agree, the choice is yours.

Just because we’re lazy, from now on all references to Kontrak™ will be referred to as “the service”. From time to time, we may release new content or functionality outlining specific terms and conditions be added to this document as an appendix.

Now we know these things are a pain to read through, however it is a necessary evil. This document provides a contract between you and Kontrak Social Pty Ltd ACN 677 831 097, so please light some candles, fill up the bath, grab a beverage and enjoy the most riveting read since your last algebra textbook.

Primary Terms

Use your common sense. If you think it’s WRONG, it probably is and don’t do it on our platform.

You must be a minimum of 13 years old to use the service. Sorry young whipper snappers, this isn’t a Wiggles approved service.

The maximum amount of any loan through our platform is $9,999. This is within the De Minimis Exemption under U.S tax Code 7872(C)(2) and must not exceed $10,000 in the aggregate. The user is solely responsible for any tax obligations arising for the use of this platform and the user confirms that any money leant is not attributed to the acquisition of income producing assets. We know money makes money, but do that with your own money not your mates, why should they take the risk on your new rollerblading monkey extravaganza?

You are responsible for your OTP or password protection, make it secure and safe. Don’t write it down on a post-it note attached to your computer or a sticker on the back. Make sure it’s somewhere no-one will find it, like that thing your aunt gave you.

You may not harass, intimidate, bully, impersonate, abuse, pick on or be a meanie to any person. Do unto others as you would have others do unto you….

You must comply with all these terms and conditions and all local, state, national, international and intergalactic laws, rules and regulations including Copyright and IP regulations. Just to reiterate: you must abide by all of them. You don’t get to pick and choose, this isn’t Sizzler.

IF you are using the service on behalf of a Company, Business or other legal Entity, you imply that you have the authority to grant all licenses set forth in these Terms & Conditions of Service and agree to these terms on behalf of the Company, Business or other legal Entity. Don’t go operating above your pay grade.

By using this service, you agree that you unequivocally understand that the service is a SOCIAL Platform and any Kontraks are NOT LEGALLY BINDING. This service does not replace financial systems and is bound by the Communication Decency Act’s Section 230. It is simply a social platform for enjoyment and peer-to-peer tracking. To be honest, I’m pretty sure Lender “Cousin Vinny” doesn’t have a 4-year financial degree from a university, years of practical experience and hasn’t studied and completed Certificate IV in Credit Management. Now I may be wrong about “Cousin Vinny” but their experience as a lender is dubious and I would not take them too seriously. To reiterate, the service is a SOCIAL platform and NOT LEGALLY BINDING. Sorry for yelling at you but wanted to be heard over boring legal explanations (Note, “Cousin Vincent” does not exist at the time of writing, he or she or they or them is fictional and not representative of any real person., Seems silly that I had to explain this to you).

You will not post any content that could be construed as: pornographic (including nudity), racist speech including SPEECH THAT IS ILLEGAL IN YOUR JURISDICTION, threatening, discriminatory, unlawful, gratuitous violence or inciting violence. We at Kontrak are parents and just warning you if you post anything that is harmful to a minor or depicts harm to a minor or anyone else, including yourself, not only will you be blacklisted from our platform, but we at Kontrak have a policy of Mandatory Reporting. Remember to think before you post. It’s not how you interpret the content, it’s about how others will interpret content. This one is super serious. To reiterate we want to make it very clear that there is no tolerance for objectionable content or abusive users within our app.

You are responsible for all carrier charges including and not limited to data costs incurred during use of the service. We are happy to pay for the platform and keep it free for use (Free version only, while stocks last), but we can’t afford to pay your phone bill as well. If you can’t budget, you really should use pre-paid.

You are responsible for all content and activities linked with your account. You may not sell, sublease or transfer your account to anyone. (Not sure how this will be policed with conjoined twins, but we will cross that bridge when we come to it, oh by the way, the bridge is just figuratively speaking). Your responsibility includes all data, text files, images, videos, sounds and other miscellaneous uploaded materials. We provide a platform for you, but you’re responsible for what you upload, so you can’t blame us for that.

You must not provide the service with any false information or create false accounts. All information provided is taken by the service as true and taken in good faith. OTP for phone number verification is required. You are not allowed to impersonate any person and people found to be impersonating others will be removed. No cat fishing (our cats really don’t like getting wet, it makes them sad).

You will not upload viruses or malicious code. Now, we’re all for free love but protection saves lives. You must not do anything which impedes the performance, reliability, look, feel or integrity of the service.

You must not impersonate or replicate the service in any form including functionality and concept. We worked hard on being us and we’re unique and special. Although impersonation is the highest form of flattery, it’s just not cool. I worked hard on this gym free body, and you can’t have it.

You must not collect or solicit user login information from other users of the service. You must also not be or use a bot, script, scrapper, spider, crawler or AI. If you’re a bot, turn back now. Our sentinels will hunt you down, we will not be part of SKYNET. The service prohibits collection of information by any automated means.

You agree that Kontrak™ is not responsible for, and does not endorse, content posted within the service. Kontrak™ does not have any obligation to prescreen, monitor, edit or remove any content. If your content violates these Terms and Conditions, you may bear legal responsibility. Now that doesn’t mean we will send a real bear to your house. That would be irresponsible of us, and yes we know Koala bears are super cute and we would all like to hug one, just note we’re just not going to agree or disagree with anything you post.

We reserve the right to refuse access to the service to anyone for any reason at any time. Now we don’t plan on keeping you out because you have the wrong shoes or no tie and dinner jacket, but sometimes we have to “build a wall” to protect our users. *Note we are an inclusive service, walls built will be in the front of individuals only and not generic broad covering walls.

Last of all you will not encourage or facilitate any breaches or violations of our Terms & Conditions of Service. I know everyone needs a sidekick, but try using your powers for good, not evil.

Upon termination of the service or of your account, all licenses and rights will cease immediately.

We reserve the right to alter and amend these terms of service, however if done so you will be required to review and agree to the updated terms.

We reserve the right to refuse service to anyone at any time within our own discretion. Especially you MATHEW!!!

To make it perfectly clear if you haven’t understood by now Kontrak Social operates a computer platform (yes its in the computer…. or your phone which is also a computer) Kontrak Social allows you to easily create and manage Social Contracts within your social circles. Don’t blame me if all your friends can fit inside a hoola hoop but it would be entertaining to watch,

By using Kontrak Social, you understand that we don’t give you ANYTHING. We simply provide a platform for social contracts among friends and family; we’re not a lender or loan shark.

Also, please note that our services and platform does not constitute or offer: legal advice, tax advice, or financial advice. You have a mother in law for that, if you don’t have a mother in law then it’s a good idea to talk to a lawyer, tax advisor, or financial expert before you start or accept a loan from someone you know, or anytime you think it would help, to be honest I think its much preferable than the mother in law idea and don’t forget that wasn’t advice…..

Privacy

Now we won’t go gossiping about you, your secrets are safe with us. All data is locked away in our black-ish boxes. We value your privacy.

But having said that, you really shouldn’t post anything you wouldn’t send to your mother, note while we wont broadcast your transaction history within the app, your current tally rating will be visible to people you interact with. So keep your tally rating up or granny will know you have been naughty. Please refer to our lengthy Privacy Policy for all the details.

Code of Conduct

If we find out you have breached these rules, we won’t just kick you out for the night, we will make sure you’re on our exclusion list. That’s right we’re like Santa, we have a naughty list too!

We may, but are not obliged to, remove, edit, block, and or monitor content which is reported by users to our moderators or which we feel is in breach of our terms of use.

Information Collection

We asked you for some information and some you just willingly told us, either way we will keep it safe. We will use the information within our platform but don’t worry we won’t post it on the dark web or print it out and leave it on the train.
