This agreement has been written in English (AUS), so if you don’t understand our slang you might want to look it up or ask an Aussie. If we’ve translated these terms into another language there may be errors, so with any discrepancies the English (AUS) version takes precedence.
By accessing kontrak.social or using the Kontrak™ Apps, or any ancillary applications made available by Kontrak Social Pty Ltd ACN 677 831 097, however accessed, you agree to be bound by our terms and conditions of service. If you don’t agree, that’s fine – we respect your view and hope you have fun doing something else. From now on all references to Kontrak™ are “the service”. From time to time we may add specific terms as an appendix.
Primary Terms
Use your common sense. If you think it’s wrong, it probably is – so don’t do it on our platform.
- You must be a minimum of 13 years old to use the service.
- The maximum amount of any loan through our platform is $9,999. This is within the De Minimis Exemption under U.S. tax code 7872(c)(2) and must not exceed $10,000 in aggregate. You are solely responsible for any tax obligations arising from use of the platform, and confirm any money lent is not attributed to the acquisition of income-producing assets.
- You are responsible for your OTP or password protection – keep it secure and don’t write it on a post-it on your computer.
- You may not harass, intimidate, bully, impersonate, abuse or pick on any person. Do unto others as you would have others do unto you.
- You must comply with all these terms and all local, state, national and international laws, rules and regulations, including copyright and IP.
- If you use the service on behalf of a company or entity, you confirm you have authority to grant these licences and agree to these terms on its behalf.
- You agree that the service is a SOCIAL platform and any Kontraks are NOT LEGALLY BINDING. It does not replace financial systems or lawyers’ contracts and is bound by the Communications Decency Act’s Section 230. It’s simply a social platform for peer-to-peer tracking.
- You will not post content that could be construed as pornographic (including nudity), racist speech including speech illegal in your jurisdiction, threatening, discriminatory, unlawful, gratuitous violence, or inciting violence. We are parents – anything harmful to a minor or depicting harm to a minor or anyone else will result in a blacklist, and we operate a policy of Mandatory Reporting. It’s not about how you interpret content, but how others will. This one is super serious.
- You are responsible for all carrier and data charges incurred during use of the service.
- You are responsible for all content and activities linked with your account. You may not sell, sublease or transfer your account to anyone.
- You must not provide false information or create false accounts. OTP phone verification is required. No impersonating others – and no catfishing.
- You will not upload viruses or malicious code, or do anything that impedes the performance, reliability, look, feel or integrity of the service.
- You must not impersonate or replicate the service in any form, including functionality and concept.
- You must not collect or solicit login information from other users, and must not be or use a bot, script, scraper, spider, crawler or AI. Collection of information by automated means is prohibited.
- You agree Kontrak™ is not responsible for, and does not endorse, content posted within the service, and has no obligation to prescreen, monitor, edit or remove content. If your content violates these terms you may bear legal responsibility.
- We reserve the right to refuse access to the service to anyone for any reason at any time.
- You will not encourage or facilitate any breaches of these terms.
- Upon termination of the service or your account, all licences and rights cease immediately.
- We may alter and amend these terms; if we do, you’ll be required to review and agree to the updated terms.
To be perfectly clear: Kontrak Social operates a computer platform that lets you easily create and manage social contracts within your social circles. By using it you understand we don’t give you anything – we simply provide a platform for social contracts among friends and family; we’re not a lender or loan shark. Our services do not constitute legal, tax or financial advice. Please talk to a lawyer, tax advisor or financial expert before starting or accepting a loan from someone you know.
Privacy
We won’t go gossiping about you – your secrets are safe with us. That said, you shouldn’t post anything you wouldn’t send to your mother. While we won’t broadcast your transaction history within the app, your current Tally rating will be visible to people you interact with. Please refer to our Privacy Policy for all the details.
Code of Conduct
If we find you’ve breached these rules, we won’t just kick you out for the night – you’ll be on our exclusion list. We may, but are not obliged to, remove, edit, block or monitor content reported to our moderators or that we feel is in breach of our terms.
